A police report has been filed accusing Diplo of distributing nude photos of a California-based woman as an act of revenge porn.

Pitchfork reports that the woman told the Los Angeles Police Department (LAPD) in August that the DJ and producer distributed the photos without permission. This is the second time the woman, named Shelly Auguste, has accused Diplo of such actions, and she has been involved in a legal battle with him since 2020. He was not charged over the initial allegation.

The LAPD submitted this latest report the Los Angeles City attorney's office in November, and a review is currently being undertaken as to whether it will be taken to court.

Overall, Auguste is suing Diplo for sexual battery, gender violence, battery, assault, defamation, fraud, intentional intrusion into private affairs, intentional infliction of emotional distress. A civil trial is currently scheduled to get underway in April 2024.

Diplo publicly denied her accusations in October 2021 after the initial claims had been filed in June of that year. He is also currently suing her for stalking, trespassing and distributing private materials.

That lawsuit was filed by Diplo in April 2021, and claims that Auguste is "dangerously unstable" and has "made relentless efforts to communicate with him" after he ended their relationship, including through fake social media accounts.

Diplo's attorney, Bryan J. Freedman, told Pitchfork: “For more than three years, Shelly Auguste has been orchestrating an ongoing smear campaign against [Diplo] — and this is just more of the same. Now, Ms. Auguste is at it yet again. But [he] will defend himself, and, just as he has done every time Ms. Auguste has defamed, harassed and attacked him and his family, he will win.”

Auguste initially filed a restraining order against Diplo in late 2020 with her alleging that Diplo had tried to pressure her into not sharing information about him.
